  • A jury found our client not guilty despite police records showing a breath test result of 0.126. Our DWI defense lawyer successfully challenged the breath test because the police officer administered the test more than one hour after the traffic stop. We were able to show that our client's actual blood alcohol content at the time of the stop was as low as 0.06. Our client had been facing a DWI conviction, a $1,200 fine, two years of probation, 40 hours of community service, a required substance abuse evaluation, a required DWI education class and the possibility of up to 180 days in jail if she violated any of those conditions. In addition, she would have had to pay the DWI driver's license surcharge for three years, an additional cost of more than $1,000. A jury found her not guilty. She got her driver's license back with no negative implications for her driving record. Furthermore, her case was expunged so there was no public record of the arrest.
